MEMPHIS LAWYER DISBARRED

On October 26, 2011, Mark D. Talley, of Memphis, Tennessee, was disbarred by Order of the Tennessee
Supreme Court.
A Petition for Discipline was filed against Mr. Talley by the Board of Professional Responsibility on
December 19, 2005, based upon his indictment for conspiracy to commit theft of property, four (4) violations of
Tennessee Securities Act, six (6) counts of theft of property over $60,000, two (2) counts of theft of property
over the value of $10,000, and one (1) count of theft of property over the value of $1,000.00. A Hearing Panel
recommended that Mr. Talley be disbarred. On December 12, 2007, Mr. Talley pled guilty to facilitation of
violations of the Securities Act.
Mr. Talley appealed the Hearing Panel’s ruling to the Chancery Court of Shelby County which ordered
that the judgment of the Hearing Panel be vacated and remanded. After a second hearing conducted on January
15, 2010, a Hearing Panel determined Mr. Talley should be disbarred. Mr. Talley filed another appeal in the
Chancery Court. On August 31, 2010, the Chancery Court affirmed the findings and recommendations of the
Hearing Panel. Mr. Talley appealed to the Tennessee Supreme Court.
Mr. Talley must comply with the requirements of Tennessee Supreme Court Rule 9, Sections 18 and 19,
should he seek reinstatement of his Tennessee law license and he may not resume practice until reinstated by
further order of this Court.
