ANDERSON COUNTY LAWYER CENSURED

On July 10, 2026, David A. Stuart, an attorney licensed to practice law in Tennessee, received a Public
Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.

Mr. Stuart is the owner of a law firm. After agreeing to represent a client in an immigration matter, Mr.
Stuart assigned the calendaring of applicable deadlines to a nonlawyer in the firm. The nonlawyer failed to
calendar the deadline for the filing of a pleading required by a scheduling order in the client’s legal matter. As a
result of the error, a request was filed by government counsel for entry of an order of removal. The nonlawyer
overlooked the email transmitting notice of the request, and, as a result, no response to the request was filed and
an order of removal was entered. Following notice of entry of the order of removal, Mr. Stuart filed a motion to
reopen which was granted by the tribunal.
By these acts, David A. Stuart has violated Rule of Professional Conduct 5.1(a) (Responsibilities of
Partners, Managers, and Supervisory Lawyers) and is hereby Publicly Censured for this violation.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to
practice law.
