MEMPHIS LAWYER SUSPENDED

On April 6, 2009, Don A. Handley of Memphis, Tennessee, was suspended by the Tennessee
Supreme Court for a period of six (6) months pursuant to Rule 9, Section 4.2, of the Rules of the Supreme
Court, the imposition of which is suspended in conjunction with a six (6) month period of probation.
During the probationary period, Mr. Handley must obtain three (3) hours of continuing legal education over
and above the hours normally required and engage the services of a practice monitor.

Mr. Handley violated disciplinary rules by practicing while on administrative suspension, by failing
to properly file a personal injury lawsuit, and by failing to candidly advise his client regarding the failure to
properly file the personal injury lawsuit. Mr. Handley’s actions violated Tennessee Supreme Court Rule 8,
Rules of Professional Conduct 1.1 (Competence), 1.3 (Diligence), 1.4 (Communication), 5.5(a)
(Unauthorized Practice of Law) and 8.4 (Misconduct).

Mr. Handley was furthered ordered to pay the expenses and costs of the disciplinary proceedings
against him, pursuant to Rule 9, Section 4.7, of the Rules of the Supreme Court and fully comply in all
respects with the requirements and obligations of suspended attorneys as set forth in Rule 9, §18.1 of the
Rules of the Supreme Court.
