ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline filed against Alan C.
Lee on December 8, 2020; upon Answer to Petition for Discipline filed by Mr. Lee on
March 8, 2021; upon the Boardâs Motion for Collateral Estoppel and Motion for Partial
Summary Judgment, Memorandum in Support of Motion for Collateral Estoppel and
Motion for Partial Summary Judgment, and Statement of Undisputed Material Facts filed
on November 5, 2021; upon entry of a Conditional Guilty Plea filed by Mr. Lee on
December 10, 2021; upon an Order Recommending Approval of Conditional Guilty Plea
entered on December 16, 2021; upon service of the Order Recommending Approval of
Conditional Guilty Plea on Mr. Lee by the Executive Secretary of the Board on December
16, 2021; upon consideration and approval by the Board on December 17, 2021; and upon
the entire record in this cause.
From all of which the Court approves the Order of the Hearing Panel and adopts the
Hearing Panelâs Order Recommending Approval of Conditional Guilty Plea as the Courtâs
Order.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND DECREED
BY THE COURT THAT:
(1)
Alan C. Lee is suspended from the practice of law for three years pursuant to
Tenn. Sup. Ct., R., § 12.2.
(2)
Mr. Lee shall comply in all aspects with Tenn. Sup. Ct. R. 9, § 28 regarding
the obligations and responsibilities of suspended attorneys.
(3)
Pursuant to Tenn. Sup. Ct. R. 9, § 31.3(d), Mr. Lee shall pay to the Board of
Professional Responsibility the expenses and costs incurred to date by the Board in this
matter in the amount of $557.50. Mr. Lee shall be assessed $100.00 for the cost of filing
this matter and pay this filing fee to the Board and shall pay to the Clerk of this Court the
court costs incurred herein. All costs, fees and expenses awarded or assessed herein shall
be paid within ninety (90) days of the entry of this Order for which execution, if necessary,
may issue.
(4)
The Board of Professional Responsibility shall cause notice of this discipline
to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.
(5)
Pursuant to Tenn. Sup. Ct. R. 9, § 28.1, this Order shall be effective upon
entry.
