NASHVILLE ATTORNEY CENSURED
On November 13, 2007, James Todd Faulkner, of Nashville, Tennessee, received a Public
Censure from the Board of Professional Responsibility. Faulkner was given notice of the Censure and did not
request a hearing. Faulkner represented a client in her divorce. The client complained to the Board that
Faulkner failed to seek or obtain the clientâs name change; failed to complete a Qualified Domestic Relations
Order and failed to file a Counter-Complaint. In his response to the Board, Faulkner denied the client requested
a name change; stated it was Faulknerâs recollection that opposing counsel was going to prepared the Qualified
Domestic Relations Order and further Faulkner advised the Board that he filed a Counter-Complaint on behalf
of the client. The client did request a name change; the Order reflected Faulkner was to prepare the QDRO and
Faulkner actually did not file a Counter-Complaint. Faulknerâs misstatements to his client and the Board
violates Rules 1.4; 8.4(c)(d) and 8.1(b) of the Tennessee Rules of Professional Conduct. Faulknerâs failure to
address his clientâs name change and failure to complete the QDRO violates Rule 1.3.
The Censure declares Faulknerâs actions to be improper ethical conduct but does not limit his
right to practice law.
