MEMPHIS LAWYER SUSPENDED

On October 15, 2008, David P. Burlison, of Memphis, Tennessee, was suspended for three (3) months
by Order of the Tennessee Supreme Court. The suspension shall begin upon his reactivation from a current
suspension for Continuing Legal Education noncompliance. Further, Mr. Burlison is ordered to make full
restitution of $9,190.00 to Dr. Michael Hellman prior to reinstatement.

The Board of Professional Responsibility filed a Petition for Discipline against David P. Burlison
pursuant to Rule 9 of the Rules of the Supreme Court of Tennessee. Mr. Burlison did not respond to the
Petition and an Order of Default was taken. A Hearing Panel determined that Mr. Burlison violated the Rules
of Professional Conduct by failing to honor an agreement to pay medical bills out of the proceeds of a
settlement. Mr. Burlison signed an agreement with Dr. David Hellman to withhold settlement funds from a
lawsuit in the total amount of $9,190.00 to satisfy outstanding medical bills. Respondent settled the case;
however, he did not withhold the funds. Mr. Burlison has been on administrative suspension for failure to
comply with CLE requirements since 2006 and he was still on administrative suspension at the time of the
hearing to determine disciplinary sanctions. Mr. Burlison is also ordered to pay the costs of the disciplinary
proceedings.

Mr. Burlison’s actions violate the following Rule(s) of Professional Conduct: 1.15(b)(c), Safekeeping of
Property and 8.4(a)(d), Misconduct.
