ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline being filed against
Daniel Clyde Fielden, II, on February 20, 2020; upon the Board filing its Motion for
Default Judgment and that Charges in Petition for Discipline be Deemed Admitted on July
30, 2021; upon the Hearing Panel entering its Order Granting Default Judgment on July
26, 2021; upon the Executive Secretary of the Board forwarding a copy of Order Granting
Default Judgment on July 26, 2021; upon the hearing in this matter being tried on August
23, 2021; upon the Judgment of the Hearing Panel imposing a Public Censure being entered
September 13, 2021; upon the Executive Secretary of the Board forwarding a copy of the
Judgment of the Hearing Panel to Mr. Fielden on September 13, 2021, upon the Board
filing its Application of Assessment of Costs on September 27, 2021, upon the Hearing
Panel entering its Findings and Judgment for Assessment of Costs on October 29, 2021;
upon the Executive Secretary of the Board forwarding a copy of the Findings and Judgment
for Assessment of Costs to Mr. Fielden on October 29, 2021; and upon the Board of
Professional Responsibility approving the Order of the Hearing Panel on December 10,
2021; and upon the entire record in this cause.
From all of which the Court approves the Judgment of the Hearing Panel and adopts
the Judgment of the Hearing Panel as the Courtâs Order.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND DECREED
BY THE COURT THAT:
(1) Daniel Clyde Fielden, II, is publicly censured pursuant to Tenn. Sup. Ct. R.
9, § 12.4.
(2) Pursuant to Tenn. Sup. Ct. R. 9, § 31.3(d), Mr. Fielden shall pay to the Board
of Professional Responsibility the expenses and costs of this matter in the amount of
$660.00 within ninety (90) days of the entry of this Order, for which execution may issue
if necessary.
(3) Mr. Fielden is assessed and shall pay to the Board of Professional
Responsibility the $100.00 filing fee for this matter and shall pay to the Clerk of this Court
any other costs incurred herein. All costs, fees and expenses awarded or assessed herein
shall be paid within ninety (90) days of the entry of this Order for which execution, if
necessary, may issue.
(4) Pursuant to Tenn. Sup. Ct. R. 9, § 28.1, this Order shall be effective upon
entry.
(5) The Board of Professional Responsibility shall cause notice of this discipline
to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.
