NASHVILLE LAWYER CONDITIONALLY SUSPENDED

On December 21, 2006, the Supreme Court of Tennessee entered an Order suspending Rodney
M. Phelps for four years with all time suspended with Phelps being on probation subject to the following
conditions:

(1) Phelps shall not violate any of the provisions of the Tennessee Rules of Professional
Conduct;

(2) Phelps shall not violate the laws of the United States or any other state other than minor
traffic violations;

(3) Phelps shall maintain a good standing status regarding professional privilege tax and
annual due; and

(4) Phelps shall comply with continuing legal education requirements;

(5) Phelps shall comply with interest in lawyer’s trust account requirements;

(6) Phelps shall keep the Board of Professional Responsibility notified of his current business
and home addresses and telephone numbers, and shall immediately notify the Board of
any change in his addresses within thirty days of the change of address;

(7) Phelps shall timely comply with all requests for information forwarded to him by the
Board;

(8) Phelps shall cooperate fully with the Board in all efforts to monitor compliance with this
Judgment; and
(9) Phelps shall not violate any term of this Order.

Disciplinary Counsel filed a Petition for Reciprocal Discipline with the Supreme Court of
Tennessee based upon a Texas Agreed Judgment suspending Phelps for four years with all time suspended, and
Phelps being on probation subject to conditions for Phelps’ neglect and failure to communicate with clients.

Section 18 of Tennessee Supreme Court Rule 9 requires Phelps to notify by registered or
certified mail all clients he represents in pending matters including all co-counsel and opposing counsel of the
Supreme Court’s Order suspending him. This disciplinary matter proceeded pursuant to Supreme Court Rule 9.
