FRANKLIN LAWYER CENSURED
On September 29, 2017, John Nichols Shelton, an attorney licensed to practice law in Tennessee,
received a Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Mr. Shelton failed to obtain approval from his client before filing pleadings and misrepresented to the
court that a document attached to the pleadings had been filed in another court. Mr. Shelton also failed to
diligently represent his clientâs interests and failed to adequately communicate with his client. In mitigation,
Mr. Shelton provided a full refund to the client and expressed remorse for his actions.
By these acts, John Nichols Shelton has violated Rules of Professional Conduct 1.2 (scope of
representation), 1.3 (diligence), 1.4 (communication), 3.3 (candor toward tribunal), and 8.4(c) (misconduct),
and is hereby Publicly Censured for these violations.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to
practice law.
