MEMPHIS ATTORNEY CENSURED

On May 12, 2006, Charles R. Curbo of Memphis, Tennessee received a Public
Censure from the Supreme Court of Tennessee.

The Board of Professional Responsibility filed a Petition for Discipline against
Mr. Curbo pursuant to Rule 9, Rules of the Supreme Court. Mr. Curbo submitted a Conditional
Guilty Plea agreeing to a Public Censure to resolve the Petition pursuant to Section 16.1 of
Tennessee Supreme Court Rule 9. Mr. Curbo admits his guilt of violating Rule 1.15(a) regarding
safekeeping property of clients, however, Disciplinary Counsel’s investigation did not reveal any
dishonesty by Mr. Curbo and no client of Mr. Curbo lost money as a result of Mr. Curbo’s
violations of Rules 1.15 and 8.4 of the Tennessee Rules of Professional Conduct. For Mr.
Curbo’s violations of these rules, the Supreme Court of Tennessee publicly censures Mr. Curbo.
The Censure declares Mr. Curbo’s actions to be improper ethical conduct but does not limit Mr.
Curbo’s right to practice law.
