Public censure on October 8, 1998. While representing a client in the purchase of a home, he
failed to pay the back taxes to the City and County even though the client delivered the money to
Kite for such a purpose. The client learned of his failure to pay the taxes some 9 months after
closing, at which time Kite admitted his fault and agreed to bring the taxes current. When he
again failed to do so, the client brought action against him in General Sessions Court and
obtained a default judgment. Kite eventually made full restitution to the client.
