NASHVILLE ATTORNEY CENSURED
On July 24, 2007, Terry R. Clayton of Nashville, Tennessee received a Public Censure from the
Board of Professional Responsibility based upon two (2) complaints. Clayton was given notice of the censure
and did not request a hearing.
In the first complaint, the client retained Clayton for representation in her personal injury case.
The client complains that Clayton failed to keep her informed and failed to respond to the clientâs request for
information. Clayton allowed the clientâs case to be dismissed without prejudice for failure to appear. The
client learned of this dismissal from defense counsel and not from Clayton. In mitigation, Clayton did file a
Motion to Set Aside the Dismissal in his clientâs case.
In the second complaint, Clayton represented a client in a divorce. In that divorce, an Order was
entered dismissing the case for lack of prosecution. Clayton did not advise the client of this dismissal until
approximately six (6) months after the case was dismissed when the client went by Claytonâs office. Claytonâs
neglect and failure to communicate with his clients violates Rules 1.3; 1.4; 3.2 and 8.4(a)(d) of the Tennessee
Rules of Professional Conduct and for these violations the Board publicly censures Clayton.
A censure declares Claytonâs actions to be unethical but does not limit Claytonâs right to practice
law.
