NASHVILLE LAWYER TRANSFERRED TO DISABILITY INACTIVE STATUS

On January 16, 2009, the Supreme Court of Tennessee issued an Order transferring attorney Sean K.
Hornbeck to disability inactive status for an indefinite time. On December 15, 2008, the Supreme Court
temporarily suspended Mr. Hornbeck from the practice of law. Mr. Hornbeck filed a Petition for Dissolution
of Temporary Suspension requesting that he be transferred to disability inactive status and requesting
dissolution of the temporary suspension. The Court ordered that Mr. Hornbeck’s license to practice law be
transferred to disability inactive status and that the Petition for Dissolution of Temporary Suspension be held in
abeyance pending a hearing on any subsequent petition requesting reinstatement to active practice.

Mr. Hornbeck must comply with Supreme Court Rule 9 in all respects, and particularly as provided in
Section 18 which governs notification to all clients being represented in pending matters, as well as co-counsel
and opposing counsel of the Supreme Court=s Order suspending his law license. Section 18 of Supreme Court
Rule 9 requires Mr. Hornbeck to deliver to all clients any papers or property to which they are entitled.
