MEMPHIS LAWYER PUBLICLY CENSURED
Gerald Wayland Pickens, a Memphis lawyer, received a public censure on April 15, 2002, by the
Board of Professional Responsibility. The censure was issued by the Board pursuant to Rule 9,
Section 8 of the Rules of the Tennessee Supreme Court. Pickens did not request a hearing in
the matter. In a personal injury case Pickens loaned his client $3,000 by check from his escrow
account prior to settling her case. Thereafter Pickens settled the property damage, but failed to
sue for the medical injuries and the statute of limitations expired. Pickens failed to adequately
communicate with his client.
The imposition of a censure declares Pickensâ actions to be improper ethical conduct, but does
not limit his right to practice law.
