PUBLIC CENSURE

The above complaint was filed against Hugh Edward Garrett, an attorney licensed to

practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup. Ct. R. 9,

the Board of Professional Responsibility considered these matters at its meeting on September

21, 2012.

The Respondent essentially abandoned his client’s case on appeal, ignoring the requests

of the Court of Criminal Appeals to either file a brief or dismiss the matter. The court removed

the Respondent and appointed a new lawyer, The Respondent failed to render competent

representation, failed to act with reasonable diligence, failed to maintain reasonable

communication, and failed to take reasonable steps to expedite litigation.

' By the aforementioned acts, Hugh Edward Garrett has violated Rules of Professional

Conduct 1.1 (competence), 1.3 (diligence), 1,4 (communication), 3.2 (expediting litigation), and

8.4(d) (misconduct) and is hereby Publicly Censored for these Violations.
