DAVIDSON COUNTY LAWYER CENSURED

On April 16, 2010, Kevin Terry, an attorney licensed to practice law in Tennessee, received a Public
Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.

In July of 2009, Mr. Terry drafted a check on his trust account, but there were insufficient funds in the
trust account to cover the check and an overdraft resulted. In August and September of 2009, additional checks
were presented for payment that Mr. Terry had drawn on the trust account which resulted in a larger overdraft
balance. Many of these additional checks were written for personal items. Mr. Terry admitted that his personal
money was in the trust account and that the trust account had not contained any client money for some time. He
claimed he did not misappropriate any client money.

Kevin Terry has violated Rule of Professional Conduct 1.15 (safekeeping property) and is hereby
Publicly Censured for this violation.

A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to
practice law.
