ORDER
On November 3, 2017, David Harris filed with this Court a Notice of Request to
be Transferred to Temporary Inactive Status pursuant to Tenn. Sup. Ct. R. 9, § 27.4(a), in
which he contended that he is suffering from a temporary disability or infirmity that
prevents him from responding to or defending against the disciplinary proceeding
currently pending against him. On November 13, 2017, the Tennessee Board of
Professional Responsibility submitted a response to Mr. Harrisâs Notice. On November
15, 2017, Mr. Harris filed an Amended Notice.
Having carefully considered this matter, the Court orders that David Harris
immediately be transferred to disability inactive status for an indefinite period and until
further order of this Court and refers this matter to a hearing panel for a formal hearing to
determine Mr. Harrisâs capacity to continue to practice law and to respond to or defend
against the complaint, pursuant to Tenn. Sup. Ct. R. 9, § 27.4(a). In such proceeding, the
burden of proof shall rest upon Mr. Harris and shall be by a preponderance of the
evidence.
