MEMPHIS LAWYER CENSURED

On September 16, 2008, Charles E. Waldman, of Memphis, Tennessee, received a Public Censure from
the Tennessee Supreme Court.

The Board of Professional Responsibility filed a Petition for Discipline against Charles E. Waldman
pursuant to Rule 9 of the Rules of the Supreme Court of Tennessee. Mr. Waldman submitted a Conditional
Guilty Plea agreeing to accept a Public Censure. Mr. Waldman violated the Rules of Professional Conduct due
to his persistent failure to comply with pro hac vice rules of the Arkansas Supreme Court leading to a finding
that he was in contempt of the Arkansas Supreme Court. His actions violate the following Rule(s) of
Professional Conduct and Disciplinary Rules: 3.4, Fairness to the Opposing Party and Counsel; 5.5,
Unauthorized Practice of Law; 8.4, Misconduct; DR 1-102, Misconduct; DR 3-101, Aiding in the Unauthorized
Practice of Law; and 7-106, Trial Conduct. Mr. Waldman is further ordered to pay the costs of the disciplinary
proceedings.

For these violations, the Supreme Court of Tennessee publicly censures Charles E. Waldman. A public
censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to practice law.
