ORDER OF REINSTATEMENâIâ
This matter is before the Court, pursuant to Tenn. Sup. Ct. R. 9, § 30.4(d), upon a
Petition for Reinstatement ï¬led on January 12, 2015, by the Petitioner, William E.
Gibson. Mr. Gibson was disbarred from the practice of law by Order of this Court on
March 20, 2009. On November 4, 2015, the Hearing Panel entered its Report and
Recommendation of the Hearing Panel recommending that Mr. Gibson be reinstated with
conditions. On February 5, 2016, the Hearing Panel entered its Agreed Order Granting
Joint Motion to Alter or Amend. The Report and Recommendation of the Hearing Panel
was considered and approved by the Board on December I 1, 2015.
From all of which the Court approves the Judgment of the Hearing Panel and
adopts the same as this Courtâs Order.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT:
1. The Petitioner, William E. Gibson, is hereby reinstated to the practice of
law in the State of Tennessee pursuant to Tenn. Sup. Ct. R. 9, § 30.4(d), subject to the
following conditions:
a. Mr. Gibson shall engage, at his expense, a practice monitor approved by
the Board for a period of ï¬ve (5) years. The practice monitor shall assist
Mr. Gibson in avoiding ethical dilemmas of the type he encountered that
led to his disbarment and provide periodic reports to the Board as
deemed necessary by Disciplinary Counsel and the practice monitor.
Pursuant to Tenn. Sup. Ct. R. 9, § 12.9(c), Mr. Gibson shall within
ï¬fteen (15) days of entry of this Order of Reinstatement provide to the
Board a list of three (3) proposed practice monitors from whom the
Board shall designate a practice monitor.
b. Mr. Gibson shall attend the Tennessee Law Institute Annual Review
Seminar each year for the next ï¬ve (5) years.
c. Mr. Gibson shall continue his counseling sessions with Dr. John B.
Averitt or another licensed mental health professional on at least a
quarterly basis for a period of ï¬ve (5) years and present proof of his
attendance to the Board.
2. Pursuant to Tenn. Sup. Ct. R. 9, § 24.3, Mr. Gibson shall pay to the Board
of Professional Responsibility the expenses and costs of this matter in the amount of
$2,098.32, and shall pay to the Clerk of this Court the costs incurred herein within ninety
(90) days of the entry of this Order, for all of which execution may issue if necessary.
3. The Board of Professional Responsibility shall cause notice of this
reinstatement to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.
