ORDER
On March 6, 2012, the Court entered an Order of Temporary Suspension pursuant
to Tenn. Sup. Ct. R. 9, ยง 4.3, suspending the law license of James A. Meaney, III, due to
Mr. Meaney's failure to respond to the Board of Professional Responsibility concerning a
complaint of misconduct. On October 16, 2013, Mr. Meaney filed a Motion to Dissolve
Order of Temporary Suspension. On November 27, 2013, Mr. Meaney filed Amended
Motion to Dissolve Order of Temporary Suspension. On December 11, 2013, a hearing
was conducted before a Hearing Panel of the Board of Professional Responsibility.
On December 12, 2013, the Hearing Panel entered its Report and
Recommendation, recommending that the temporary suspension imposed by the Order of
Temporary Suspension be dissolved. A copy of the Report and Recommendation of the
4.3 Hearing Panel is attached hereto and incorporated herein by reference.
It is, therefore, ORDERED, ADJUDGED and DECREED that:
The temporary suspension imposed upon James A. Meaney, III, by Order

of Temporary Suspension filed March 6, 2012, is hereby dissolved.
Mr. Meaney shall reimburse and pay to the Board of Professional

Responsibility the costs and expenses of this proceeding in the amount of $146.67 and
shall pay to the Clerk of this Court the costs incurred herein, for all of which execution
shall issue, if necessary.

REPORT AND RECOMMENDATION

On December 11, 2013, a hearing panel consisting of Wade Davies, Michael Callaway,
and Scott Reams, members of the Board of Professional Responsibility, held a hearing by
telephone on Mr. Meany's petition to dissolve his temporary suspension, pursuant to Tennessee
Supreme Court Rule 9, Section 4.3. James A. Meaney, III, petitioner, and Krisann Hodges,
Disciplinary Counsel participated.
For the following reasons, the panel recommends that the Supreme Court lift the
temporary suspension:
1. On February 28, 2012, Disciplinary Counsel filed a petition with this Court for a
temporary suspension based on Mr. Meaney's failure to respond to the Board of Professional
Responsibility concerning complaints of misconduct against him.
2. On March 6, 2012, the Supreme Court of Tennessee entered an order of
temporary suspension. Pursuant to Tennessee Supreme Court Rule 9, Section 4.3, the Court
found that James A. Meaney, III, had failed to respond to the Board of Professional
Responsibility concerning a complaint of misconduct and temporarily suspended Mr. Meaney
from the practice of law.
3. On October 16, 2013, Mr. Meaney filed a motion to dissolve the order of
temporary suspension.

4. On or about November 22, 2013, Mr. Meaney filed an amended motion to
dissolve the order of temporary suspension.
5. Mr. Meaney has shown that he filed a full written response to the disciplinary
complaint in question. Further, there has been a full hearing and judgment of the hearing panel.
The hearing panel judgment is currently on appeal.
6. The narrow issue here is whether Mr. Meaney's temporary suspension should be
lifted under Tennessee Supreme Court Rule 9, Section 4.3. This issue is unrelated to the merits
of the disciplinary complaint. Because the circumstance which led to the temporary suspension
has been cured by Mr. Meany's filing a response to the Disciplinary petition, this panel finds that
Mr. Meaney has shown good cause for dissolving the temporary suspension.
Accordingly, the panel recommends that the Court dissolve the order of temporary
suspension with the understanding that this recommendation does not affect the pending
disciplinary case.
