KNOX COUNTY LAWYER CENSURED
On October 14, 2015, Horace Maynard Brown, an attorney licensed to practice law in Tennessee,
received a Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Mr. Brown represented his client in a bankruptcy case. While the bankruptcy case was pending, Mr.
Brownâs client settled a personal injury case. Mr. Brown did not file a motion to approve the personal injury
settlement or the payment of attorneyâs fees to the personal injury lawyer, and none of the money was paid to
the bankruptcy trustee. Mr. Brown took possession of a portion of the settlement funds, but he failed to place
the settlement proceeds in a trust account and he did not maintain records of the disbursements of the funds to
his clientâs creditors. Additionally, Mr. Brown utilized only one bank account for both his funds and client
funds. The bankruptcy trustee moved for sanctions and Mr. Brown was ordered to disgorge his fee.
By these acts, Horace Maynard Brown, has violated Rule of Professional Conduct 1.1 (competence),
1.15 (safekeeping funds), and 3.4(c) (knowingly disobey an obligation under the rules of a tribunal) and is
hereby Publicly Censured for these violations.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to
practice law.
