On November 20, 2007, Byron Ray Simpson, of Nashville, Tennessee, received a Public
Censure from the Board of Professional Responsibility. Simpson was given notice of the Censure and did not
request a hearing. On June 15, 2007, the Tennessee Lawyers Assistance (TLAP) Program reported to the Board
of Professional Responsibility that Simpson was non-compliant with his TLAP contract. On April 12, 2005,
Simpson was reinstated to the practicHRIODZFRQGLWLRQHGLQSDUWXSRQ6LPSVRQ¶VFRPSOLDQFHZLWKKLV7/$3
contract. Simpson subsequently entered into a new monitoring advocacy agreement with TLAP extending his
monitoring agreement by two (2) years until May 31, 2010. TLAP further reported that Simpson was currently
FRPSOLDQWZLWKKLV7/$3FRQWUDFW6LPSVRQ¶VQRQ-compliance with his TLAP contract which was a condition
of his reinstatement by the Tennessee Supreme Court violates Rule 8.4(d) of the Tennessee Rules of
