ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline filed against Inez
Beatrice Warner on February 23, 2018; upon a Response to Petition for Discipline filed on
May 30, 2018; upon the Hearing Panel entering its Findings of Fact, Conclusions of Law
and Judgment on April 19, 2021; upon service of the Hearing Panelâs Findings of Fact,
Conclusions of Law and Judgment upon Ms. Warner by the Executive Secretary of the
Board on April 19, 2021; upon the Hearing Panel entering its Order on Board of
Professional Responsibilityâs Application for Assessment of Costs on July 16, 2021; upon
service of the Order on Board of Professional Responsibilityâs Application for Assessment
of Costs upon Ms. Warner by the Executive Secretary of the Board on July 19, 2021; upon
the Motion of the Board of Professional Responsibility to Alter or Amend the Judgment of
the Hearing Panel filed on July 23, 2021; upon the Hearing Panelâs Order on the Board of
Professional Responsibilityâs Motion to Alter or Amend entered on August 27, 2021; upon
service of the Order on the Board of Professional Responsibilityâs Motion to Alter or
Amend upon Ms. Warner by the Executive Secretary of the Board on August 27, 2021;
upon consideration and approval of the Hearing Panelâs Findings of Fact, Conclusions of
Law and Judgment and Order on the Board of Professional Responsibilityâs Motion to
Alter or Amend by the Board on September 10, 2021; upon Ms. Warner providing a written
Waiver of Appeal to the Board on September 14, 2021; and upon the entire record in this
cause.
From all of which the Court approves the Orders of the Hearing Panel and adopts
the Hearing Panelâs Findings of Fact, Conclusions of Law and Judgment and as amended
by the Order on Board of Professional Responsibilityâs Motion to Alter or Amend as the
Courtâs Order.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND DECREED
BY THE COURT THAT:
(1) Inez Beatrice Warner is publicly censured pursuant to Tenn. Sup. Ct. R. 9, §
12.4.
(2) Pursuant to Tenn. Sup. Ct. R. 9, § 12.7, Ms. Warner shall, within ninety (90)
days of the entry of this Order, make restitution to the following individuals and shall
furnish to the Board of Professional Responsibility proof of restitution. In the event
restitution is made by the Tennessee Lawyerâs Fund for Client Protection (TLFCP), Ms.
Warner shall reimburse TLFCP in the same amount.
(a) Maria Hernandez, $6,825.00
(b) Sharon Dumas, $1,000.00
(c) Elgen McFerren, $950.00
(3) Pursuant to Tenn. Sup. Ct. R. 9, § 31.3(d), Ms. Warner shall pay to the Board
of Professional Responsibility the expenses and costs of this matter in the amount of
$1,539.36.
(4) Pursuant to Tenn. Sup. Ct. R. 9, § 28.1, this Order shall be effective upon
entry.
(5) Ms. Warner shall pay to the Clerk of this Court its costs incurred herein, if
any, within ninety (90) days of the entry of this Order, for which execution may issue if
necessary.
(6) The Board of Professional Responsibility shall cause notice of this discipline
to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.
