SHELBYVILLE LAWYER CENSURED
Clarence W. Phillips, of Shelbyville, was publicly censured by the Board of
Professional Responsibility on August 30, 2006. The censure was issued by the Board
pursuant to Rule 9, Section 8 of the Rules of the Tennessee Supreme Court. Phillips
did not request a hearing on the matter.
A complaint alleging ethical misconduct was filed against Phillips involving his
solicitation of clients. The Board found that on February 2, 2006, Phillips improperly
made a live telephonic solicitation to another lawyer's client regarding possible
representation of this individual in an automobile injury and accident matter, after
obtaining information identifying this person from accident reports. The potential client
did not initiate any contact whatsoever from Phillips regarding possible employment.
Attorneys in Tennessee are not permitted to solicit clients in this fashion, and
must limit their direct communications in this regard to written or recorded
communications that may be mailed or electronically transmitted.
