On April 16, 2010, Cynthia Davis, an attorney licensed to practice law in Tennessee, received a Public
Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
In January, 2008, Ms. Davis was retained to defend a divorce action. Over a five-month period, Ms.
Davis failed to file any responsive pleadings or send out any correspondence on behalf of her client. During that
period, opposing counsel filed a Motion for Default and threatened to proceed with a hearing unless an Answer
was filed in the case. Ms. Davis failed to timely notify her client of opposing counselâs Motion for Default. Ms.
Davis eventually filed responsive pleadings on behalf of her client, in May, 2008, but her delay in doing so led
to her termination. Ms. Davisâ lack of diligence was prejudicial to her client who was in need of temporary
support from her husband.
By her actions, Cynthia Davis has violated Rule of Professional Conduct 1.3 (diligence), 1.4
(communication) and 3.2 (expediting litigation). For this violation, the Board of Professional Responsibility
publicly censures Cynthia Davis. A public censure is a rebuke and warning to the attorney, but it does not affect
the attorneyâs ability to practice law.
