ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline filed against Philip
Joseph Perez on July 3, 2020; upon a Supplemental Petition for Discipline filed on
September 2, 2020; upon a Motion for Default Judgment and that Charges in Petition for
Discipline be Deemed Admitted filed on October 20, 2020; upon an Order Granting
Default Judgment entered on November 11, 2020; upon service of the Order Granting
Default Judgment on Mr. Perez by the Executive Secretary of the Board on December 2,
2021; upon Second Supplemental Petition for Discipline filed on January 29, 2021; upon
Third Supplemental Petition for Discipline filed on April 16, 2021; upon a Motion for
Default Judgment and that Charges in Petition for Discipline be Deemed Admitted as to
Supplemental Petitions Two and Three filed on November 16, 2021; upon an Order of
Default Judgment as to Supplemental Petitions Two and Three entered December 1, 2021;
upon service of the Order of Default Judgment on Mr. Perez by the Executive Secretary of
the Board on March 2, 2022; upon hearing to determine final discipline on February 2,
2022; upon Judgment of the Hearing Panel entered March 2, 2022; upon service of the
Judgment of the Hearing Panel on Mr. Perez by the Executive Secretary of the Board on
March 2, 2022; upon the Board of Professional Responsibilityâs Application for
Assessment of Cost filed March 14, 2022; upon Findings and Judgment for Assessment of
Costs entered March 31, 2022; upon service of the Findings and Judgment for Assessment
of Costs on Mr. Perez by the Executive Secretary of the Board on March 31, 2022; upon
expiration of the appeal period with no appeal taken; and upon the entire record in this
cause.
From all of which, the Court approves the Order of the Hearing Panel and adopts
the Hearing Panelâs Judgment as the Courtâs Order.
On January 27, 2020, Mr. Perez was temporarily suspended by this Court pursuant
to Tenn. Sup. Ct. R. 9, § 12.3 (Case No. M2020-00138-SC-BPR-BP). To date, Mr. Perez
has not requested nor been granted reinstatement.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED, AND
DECREED BY THE COURT THAT:
(1) Mr. Perez is permanently disbarred from the practice of law pursuant to Tenn.
Sup. Ct. R. 9 § 12.1.
(2) Mr. Perez shall comply in all aspects with Tenn. Sup. Ct. R. 9, § 28 regarding
the obligations and responsibilities of disbarred attorneys.
(3) Pursuant to Tenn. Sup. Ct. R. 9, § 31.3(d), Mr. Perez shall pay to the Board
of Professional Responsibility the expenses and costs incurred to date by the Board in this
matter in the amount of $2,258.33 which includes an assessed $100.00 for the cost of filing
this matter, and shall pay to the Clerk of this Court the court costs incurred herein. All
costs, fees, and expenses awarded or assessed herein shall be paid within ninety (90) days
of the entry of this Order, for which execution, if necessary, may issue.
(4) The Order of Temporary Suspension entered January 27, 2020 (Case No.
M2020-00138-SC-BPR-BP) is hereby dissolved.
(5) The Board of Professional Responsibility shall cause notice of this discipline
to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.
(6) Pursuant to Tenn. Sup. Ct. R. 9, § 28.1, this Order shall be effective upon
entry.
