MONTGOMERY COUNTY LAWYER PUBLICLY CENSURED

On May 2, 2005, the Board of Professional Responsibility issued a Public
Censure to Nan Shelby Calloway of Clarksville, Tennessee. She did not request a hearing.
Calloway failed to adequately communicate with her client resulting in the client’s decision to
hire another attorney to complete her legal matter. Calloway and client could not agree on the
amount of refund to be made to the client, and Calloway did not timely resolve this issue with
the Nashville Bar Association Fee Dispute Committee. Calloway has repaid the client the legal
fees the client paid to Calloway for the legal work.

The Board determined Calloway’s conduct violated Rules 1.1, 1.3, 1.4, 1.5 and
8.4(a)(d) of the Tennessee Rules of Professional Conduct. A public censure is a form of
discipline that declares the conduct of the lawyer improper but does not limit the lawyer’s right
to practice law.
