ORDER
On December 18, 2014, the Tennessee Board of Professional Responsibility
submitted to this Court a notice of contention of disability pursuant to Tenn. Sup. Ct. R.
9, § 27.4 notifying the Court of William C. Gosnell’s contention that he is suffering from
a disability by reason of mental or physical infirmity or illness that prevents him from
continuing to practice law and by implication prevents him from responding to or
defending himself in the disciplinary proceeding currently pending against him.
Having carefully considered this matter, the Court Orders that William C. Gosnell
is immediately transferred to disability inactive status for an indefinite period and until
further order of this Court and refers this matter to a hearing panel for a formal hearing to
determine Mr. Gosnell’s capacity to continue to practice law and to respond to or defend
against the complaint, pursuant to Tenn. Sup. Ct. R. 9, §27.4(a). In such proceeding, the
burden of proof shall rest upon Mr. Gosnell and shall be by a preponderance of the
evidence.
