MEMPHIS LAWYER SUSPENDED
On June 4, 2010, Timothy Darnell Flowers of Memphis, Tennessee, was suspended from the practice of law for
one (1) year by the Tennessee Supreme Court. The Supreme Court filed an opinion affirming the ruling of a Hearing
Panel suspending Mr. Flowers for one (1) year and ordering restitution to three (3) clients.
On December 28, 2005, the Board of Professional Responsibility filed a Petition for Discipline, Docket No. 2005-
1564-9-JJ, against Timothy Darnell Flowers. The Board filed a Supplemental Petition for Discipline on May 31, 2006
and a Second Supplemental Petition for Discipline on September 7, 2006. The petitions incorporated a total of ten (10)
complaints of disciplinary misconduct by Mr. Flowers. Eight (8) of the complainants were clients of Mr. Flowers. The
allegations consisted of claims that Mr. Flowers neglected their individual immigration cases by failing to file timely
appeals, briefs, or other pleadings. Another complaint concerned Mr. Flowersâ failure to prosecute eighteen (18) appeals
filed in the United States Court of Appeals for the Sixth Circuit. The appeals were all dismissed because Mr. Flowers
failed to pay filing fees, failed to file required forms, or failed to file briefs.
After a full hearing held on June 21, 2007, a Hearing Panel determined that Mr. Flowers should be suspended for
one (1) year and that he should be required to pay restitution to three (3) clients. The disciplinary sanction was affirmed
upon appeal by the Chancery Court of Shelby County. The Tennessee Supreme Court also affirmed the sanction.
Mr. Flowersâ actions violate the following Rules of Professional Conduct: 1.1, Competence; 1.2, Scope of
Representation; 1.3, Diligence; 1.4, Communication; 1.5, Fees; 1.15, Safekeeping Property; 1.16, Declining and
Terminating Representation; 3.3, Candor to the Tribunal; 3.4 Fairness to Opposing Party and Counsel; 4.4, Respect and
Rights of Third Persons; 5.5, Unauthorized Practice of Law; 8.1, Bar Admission and Disciplinary Matters; and 8.4,
Misconduct. Further, Mr. Flowers violated Disciplinary Rules 7-101, Representing a Client Zealously; 7-102,
Representing a Client Within the Bounds of the Law; and 9-102, Preserving Identity of Funds and Property of a Client.
Mr. Flowers must comply with Section 18 of Rule 9, Rules of the Supreme Court, regarding the obligations and
responsibilities of suspended attorneys. He must pay the Boardâs costs and expenses prior to reinstatement to the practice
of law.
