MEMPHIS LAWYER SUSPENDED
On February 21, 2006, the Tennessee Supreme Court temporarily suspended the law
license of Barry E. Gilmore, a Memphis attorney, pursuant to Section 4.3 of Tennessee Supreme
Court Rule 9. The Board of Professional Responsibility had petitioned the Court to temporarily
suspend Gilmoreâs law license because of the Boardâs concern that Gilmore posed a substantial
threat of irreparable harm to the public due to his own admission of serious depression which
resulted in his abandonment of his law practice and his clients in the summer and fall of 2005.
Pursuant to Rule 9, Section 4.3, Gilmore cannot accept new clients or undertake any new
representation. He may represent existing clients for 30 days, after which he cannot represent
them. Gilmore may file an application with the Tennessee Supreme Court requesting a
dissolution or modification of the temporary suspension order. If he makes such an application,
a hearing to consider whether the suspension should be continued, modified or dissolved will be
conducted before a panel consisting of two members of the Board and one Hearing Committee
member from Shelby County.
