NASHVILLE LAWYER SUSPENDED FROM PRACTICE OF LAW
On February 24, 2003, the Supreme Court of Tennessee entered an Order suspending the law
license of Ted A. Burkhalter for a period of five years retroactive to January 29, 1997, the date upon
which he was first suspended by the Supreme Court.
Disciplinary Counsel filed a Petition for Discipline based upon three separate complaints,
pursuant to Rule 9, Rules of the Supreme Court of Tennessee.
Pursuant to Tennessee Supreme Court Rule 9, Section 16.1 respondent agreed to enter a
Conditional Guilty Plea to the petition in exchange a five year suspension.
Burkhalter pled guilty to failing to adequately maintain his escrow account; failing to keep proper
records of his escrow account; and improperly notarizing two signatures to a legal document without
the person being present or acknowledging their signature.
This disciplinary matter was held pursuant to Supreme Court Rules 8 and 9. In Tennessee
suspended lawyers may, after the passage of their suspension, apply for reinstatement of their law
licenses. However, to succeed these lawyers must carry their burden of proof by clear and convincing
evidence that their reinstatement will not be detrimental to the integrity and standing of the bar or the
administration of justice or be subversive to the public interest.
