NASHVILLE LAWYER TEMPORARILY SUSPENDED

On April 10, 2008, the Supreme Court of Tennessee issued an Order summarily and temporarily
suspending David H. Hornik’s license to practice law upon finding that Mr. Hornik had failed to respond to the
Board of Professional Responsibility concerning a complaint of misconduct. Section 4.3 of Supreme Court
Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law for failing to
respond to the Board of Professional Responsibility.

The April 10, 2008, Order precludes Mr. Hornik from accepting any new cases effective April 10, 2008.
Mr. Hornik must cease representing existing clients effective May 10, 2008. After May 10, 2008, Mr. Hornik
shall not use any lawyer, legal assistant, or law clerk or maintain a presence where a practice of law is
conducted.

The Order requires Mr. Hornik to notify by registered and certified mail all clients he represents in
pending matters, as well as co-counsel and opposing counsel of the Supreme Court’s Order suspending his law
license. Section 18 of Supreme Court Rule 9 requires Mr. Hornik to deliver to all clients any papers or property
to which they are entitled.

This suspension remains in effect until dissolution or modification by the Supreme Court. Mr. Hornik
may for good cause request dissolution or modification of this suspension by petition to the Supreme Court.
