ORDER DISSOLVING DISABILITY INACTIVE STATUS
This matter is before the Court, pursuant to Tenn. Sup. Ct. R. 9, § 27.7, upon a
Certified Petition to Transfer Attorney from Disability Inactive Status to Active Status,
filed on June 1, 2017. Ms. Mathes’ law license was transferred to disability inactive
status by Order of this Court on October 8, 2012.
The Board has filed a response stating that there is no objection to removing Ms.
Mathes from disability inactive status; however, the Board notes that on June 26, 2012,
Ms. Mathes was temporarily suspended from the practice of law for failure to respond to
a disciplinary complaint in Docket No. M2012-01307-SC-BPR-BP. Ms. Mathes did not
seek, nor has she been granted, reinstatement from that temporary suspension.
Further, the Board states that pursuant to Tenn. Sup. Ct. R. 9, § 27.7(c), there are
pending disciplinary complaints which must be resolved before the effective date of
reinstatement.
IT IS, THEREFORE, CONSIDERED,
DECREED BY THE COURT THAT:

ORDERED,

ADJUDGED

AND

1.
Gail Ostby Mathes shall be removed from disability inactive status. The
Order of Temporary Suspension entered on June 26, 2012 in Docket No. M2012-01307SC-BPR-BP, remains in full force and effect.
2.
That any pending disciplinary proceedings must be resolved prior to the
effective date of reinstatement, pursuant to Tenn. Sup. Ct. R. 9, § 27.7(c).
