ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline against Jerry
Dell Holmes, Jr., filed July 26, 2018; upon Mr. Holmesâ Response in Opposition
to Petition for Discipline filed August 21, 2018; upon the filing of a Conditional
Guilty Plea by Mr. Holmes on February 21, 2019; upon entry of an Order
Recommending Approval of Conditional Guilty Plea on February 21, 2019; upon
service of the Order Recommending Approval of Conditional Guilty Plea upon
Mr. Holmes by the Executive Secretary of the Board on February 21, 2019, and
upon consideration and approval of the Conditional Guilty Plea by the Board on
March 8, 2019.
From all of which the Court approves the recommendation of the Hearing
Panel and adopts the Hearing Panelâs Order Recommending Approval of
Conditional Guilty Plea as the Courtâs Order.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT THAT:
(1) Mr. Jerry Dell Holmes, Jr. is publicly censured for his misconduct.
(2) Pursuant to Tenn. Sup. Ct. R. 9, § 28.1, this Order shall be effective
upon entry.
(3) Pursuant to Tenn. Sup. Ct. R. 9, § 31.3(d), and in accordance with
the Conditional Guilty Plea, Mr. Holmes shall pay to the Board of Professional
Responsibility the expenses and costs of this matter in the amount of $700.83 and
shall pay to the Clerk of this Court the costs incurred herein, within ninety (90)
days of the entry of this Order, for all of which execution, if necessary, may issue.
(4) The Board of Professional Responsibility shall cause notice of this
discipline to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.
