SHELBY COUNTY LAWYER CENSURED

On March 16, 2012, Homer L. Cody of Memphis, Tennessee, was Publicly Censured by the Tennessee
Supreme Court pursuant to Rule 9, Section 4.4, of the Rules of the Supreme Court.

Mr. Cody represented parties to the same action that had adverse interests against one another causing a
direct conflict of interest in his representation. Both the Tennessee Court of Appeals and the trial court ordered
Mr. Cody to refrain from representation of either party. Despite the court order, Mr. Cody continued to provide
legal services to one of the parties.

By the aforementioned acts, Homer L. Cody has violated Rule 1.7 (conflict of interest), 3.1 (meritorious
claims and contentions), and 8.4 (misconduct) of the Rules of Professional Conduct and is hereby Publicly
Censured for this violation.

A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to
practice law.
