NASHVILLE LAWYER SUSPENDED

On April 18, 2012, the Supreme Court of Tennessee issued an Order suspending Matthew Fort Mayo
from the practice of law for one (1) year, retroactive to January 31, 2011. At present, Mr. Mayo is also
suspended for noncompliance with Tenn. Sup. Ct. R. 43, Section 14 regarding certification of an IOLTA
account and for noncompliance with continuing legal education.
The Board of Professional Responsibility filed two (2) Petitions for Discipline against Mr. Mayo
pursuant to Rule 9 of the Rules of the Supreme Court of Tennessee encompassing three (3) complaints of
disciplinary misconduct. The Petitions were consolidated for hearing due to the similarity of the complaints,
and Mr. Mayo entered into a Conditional Guilty Plea. Mr. Mayo failed to respond to the Board concerning a
complaint of misconduct. He failed to timely file the transcript and record with the appellate court despite
being granted an extension. He also failed to timely file a brief and failed to properly serve it on the opposing
party. Finally, Mr. Mayo failed to appear for a client’s sentencing hearings.
His actions violate the following Rule(s) of Professional Conduct: 1.3, Diligence; 3.2, Expediting
Litigation; 8.1(b), Bar Admission and Disciplinary Matters; and 8.4(a) and (d)Misconduct.
Mr. Mayo must comply with the requirements of Tennessee Supreme Court Rule 9, Sections 18 and 19,
should he seek reinstatement of his Tennessee law license and he may not resume practice until reinstated by
further order of the Court.
