KNOXVILLE LAWYER CENSURED

On January 5, 2007, the Board of Professional Responsibility issued a Public Censure as
to attorney John Sholly, who practices law in Knoxville, Tennessee.

Mr. Sholly was retained to represent a client in regards to a matter before the Court of
Appeals. He filed a notice of appeal on September 16, 2004. The record was filed on November
19, 2004. Mr. Sholly did not file a brief, nor did he request an extension of time. A show cause
order was entered on March 14, 2005, to show why the appeal should not be dismissed. Mr.
Sholly did not respond. On April 26, 2005, the court ordered Respondent to file a brief before
May 10, 2005. No brief was filed. On May 13, 2005, the court ordered Mr. Sholly to appear
before it on May 31, 2005. Mr. Sholly appeared before the court. The court found him in
contempt and fined him $50.

The Board of Professional Responsibility found that Mr. Sholly violated Rules of
Professional Conduct 1.3, 3.2, 3.5(e), and 8.4(d) (Rule 8, Rules of the Supreme Court of
Tennessee). The Board thereby voted to censure Mr. Sholly. Mr. Sholly did not request a
hearing regarding this censure and the censure became final. This Public Censure does not
suspend the right of Mr. Sholly to continue to practice law.
