ORDER
On October 20, 2015, Thomas F. Mabry submitted to this Court a notice of
disability pursuant to Tenn. Sup. Ct. R. 9, § 27.4, in which he contended that he is
suffering from a disability by reason of mental or physical infirmity or illness that
prevents him from responding to or defending against the disciplinary proceeding
currently pending against him. On October 21, 2015, the Tennessee Board of
Professional Responsibility submitted a response to Mr. Mabry's notice of disability.
Having carefully considered this matter, the Court orders that Thomas F. Mabry is
immediately transferred to disability inactive status for an indefinite period and until
further order of this Court and refers this matter to a hearing panel for a formal hearing to
determine Mr. Mabry's capacity to continue to practice law and to respond to or defend
against the complaint, pursuant to Tenn. Sup. Ct. R. 9, § 27.4(a). In such proceeding, the
burden of proof shall rest upon Mr. Mabry and shall be by a preponderance of the
evidence.
