MEMPHIS LAWYER SUSPENDED
On September 8, 2008, Barry E. Gilmore of Memphis, Tennessee, was suspended by the Tennessee
Supreme Court for a period of one (1) year pursuant to Rule 9, Section 4.2, of the Rules of the Supreme Court.
Mr. Gilmore violated disciplinary rules by his failure to communicate with clients, failure to prosecute
pending cases, failure to properly notify clients, opposing counsel and the Courts of his new business address
after moving his law practice, and failure to enter orders of withdrawal in cases where he ceased providing legal
services to clients. Mr. Gilmoreâs actions violated Tennessee Supreme Court Rule 8, Rules of Professional
Conduct 1.3 (Diligence), 1.4(a)(b) (Communication), 1.16(a)(1)(2)(d)(1)(2) (Declining and Terminating
Representation), 3.4(c)(Fairness to Opposing Party and Counsel), 8.4(a)(c)(d) (Misconduct) and Rule 9, §§
18.1, 18.6 and 18.8.
Mr. Gilmore was furthered ordered to pay the expenses and costs of the disciplinary proceedings against
him, pursuant to Rule 9, Section 4.7, of the Rules of the Supreme Court and fully comply in all respects with the
requirements and obligations of suspended attorneys as set forth in Rule 9, §18.1 of the Rules of the Supreme
Court.
Mr. Gilmore may return to the practice of law only after reinstatement by order of the Supreme Court.
