NASHVILLE ATTORNEY CENSURED

On March 4, 2008, Jack Howell Davis, Sr., of Nashville, Tennessee, received a Public Censure from the
Board of Professional Responsibility based upon three (3) Complaints. Davis was given notice of the Censure
and did not request a hearing.

The first complaint concerned Davis’ representation of a client in a divorce. Davis filed an appeal for
the client which was later dismissed due to Davis’ failure to pay the litigation tax. The Court of Appeals Order
stated that the Court had on two (2) occasions directed the Respondent’s client to pay the tax or show cause why
it should not be paid. The Court of Appeals Order sent to Davis on behalf of his client was returned to the Clerk
as “unclaimed.” In the second complaint the Respondent’s client states that he attempted unsuccessfully to
obtain a copy of his final decree from the Respondent unsuccessfully for months. Davis failed to accept or
return his client’s calls. Lastly, in the third complaint, Davis represented a third client in a divorce. Davis
failed to keep that client informed regarding the client’s case and a March, 2007 hearing.

Davis’ neglect and failure to communicate with his clients violates Rules 1.3; 1.4; 8.1 and 8.4 of the
Rules of Tennessee Professional Conduct. For these violations the Board publically censures Davis. The
censure declares Davis’ actions to be improper but does not limit Davis’ right to practice law.
