BOARD OF PROFESSIONAL RESPONSIBILITY

July 15, 2005
KNOXVILLE LAWYER SUSPENDED BY SUPREME COURT
By Order of the Tennessee Supreme Court entered July 12, 2005, Stanley R. Barnett, a
Knoxville attorney, was suspended from the practice of law in this state for a period of three
years retroactive to April 1, 2002.
A Petition for Discipline had been filed against Mr. Barnett by the Board of Professional
Responsibility on May 12, 2003. On June 14, 2005, Mr. Barnett entered into a Conditional Plea
of Guilty with the Board of Professional Responsibility to resolve the Petition for Discipline in
exchange for the three-year suspension. Mr. Barnett failed to comply with the court-ordered
conditions on his earlier reinstatement, failed to refund an unearned portion of a fee to a client
upon being terminated, failed to appear at scheduled court dates in cases where he was counsel
of record, neglected cases and failed to communicate with his clients, failed to return one client's
file upon request after being terminated, failed to respond to requests for information from the
Office of Disciplinary Counsel, and failed notify his clients of his interim suspension as required
by the Supreme Court Rules.
Mr. Barnett admitted violating DR 1-102(A)(1)(4)(5)(6)(7), DR 2-110(A)(1)(2)(3), DR 6-
101(A)(1)(2)(3), DR 7-101(A)(1)(2)(3)(4), DR 7-106(A)(C)(7), and DR 9-102(B)(4) of the Code
of Professional Responsibility.
The Court further ordered Mr. Barnett to pay restitution to clients in six disciplinary
complaint files in the amount of any unearned portion of any fees.
The Court further ordered that Mr. Barnett pay the costs of the disciplinary proceedings
and that he comply in all respects with Supreme Court Rule 9, and specifically Section 18 of said
Rules, regarding the obligations and responsibilities of suspended attorneys.
1
Mr. Barnett will be reinstated to the practice of law at the expiration of the three-year
suspension period only upon petition for reinstatement to the Supreme Court and proving by
clear and convincing evidence that he has the moral qualifications, competency, and learning in
the law required for admission and that his resumption of practice will not be detrimental to the
integrity and standing of the bar or the administration of justice or subversive to the public
interest.
