SHAW, CLARK L. BPR # 010836
May 20, 1997 County:Davidson District:5
Public censure on May 20, 1997. The censure resulted from 3 separate complaints filed with the
Board. In the first complaint, he was hired to file a civil action concerning a car wreck and failed
to file a claim or counter-claim prior to the statute of limitations' expiration. In the second
complaint. he represented a client who had failed to pay a judgment resulting in issuance of a
garnishment on her employer. The employer asked Shaw for advice about answering the
garnishment and he advised the employer not to worry about it, he would take care of it.
Because he failed to advise the employer to answer the garnishment, a $1,200 judgment was
entered against the employer. The employee then quit her job, allowing the employer no
recourse but to pay the judgment. In the third complaint, he was employed to collect past due
child support and to obtain a wage assignment for an Illinois resident. He attended court on July
9, 1995 and the Court granted the relief sought and instructed Shaw to prepare the order. Shaw
said he prepared the order and filed it with the clerk and that it must have been lost by the clerk.
Approximately 8 months passed and the case was noticed for dismissal due to inactivity. The
client employed other counsel and the order was promptly prepared and filed.
