MEMPHIS LAWYER CENSURED

On June 23, 2011, Kathleen L. Caldwell of Memphis, Tennessee, was publicly censured by the
Tennessee Supreme Court.

The Board of Professional Responsibility filed a Petition for Discipline against Ms. Caldwell pursuant to
Rule 9 of the Rules of the Supreme Court of Tennessee. Mr. Caldwell submitted a Conditional Guilty Plea that
was approved by the Hearing Panel, the Board and the Supreme Court. Ms. Caldwell violated the Rules of
Professional Conduct by resuming the practicing law prior to paying the costs of her disciplinary proceedings as
required by the Supreme Court’s Order of Enforcement. Ms. Caldwell’s actions violated the following Rules of
Professional Conduct: 1.16(a)(1)(Declining and Terminating Representation), 5.5(a)(Unauthorized Practice of
Law),and 8.4 (Misconduct). Ms. Caldwell was further ordered to pay the costs of the disciplinary proceedings.

For these violations, the Supreme Court of Tennessee publicly censured Kathleen L. Caldwell. A public
censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to practice law.
