ORDER OF REINSTATEMENT Mâ
This matter is before the Court upon a Petition for Reinstatement ï¬led on January
12, 2012, by the Petitioner, Douglas P. Nanney; upon an Answer to the Petition ï¬led by
Disciplinary Counsel on January 18, 2012; upon the Judgment granting reinstatement
entered by the Hearing Panel on June 7, 2012; upon review and approval by the Board of
Professional Responsibility on June 22, 2012; upon notiï¬cation from Mr. Nanney that no
appeal will be taken from the Judgment of the Hearing Panel; upon the response of the
Tennessee Commission on Continuing Legal Education and Specialization; and upon the
entire record in this cause.
From all of which the Court approves the recommendation of the Hearing Panel,
subject to the additional requirement in item 3 below.
It is, therefore, ordered, adjudged and decreed by the Court that:
1. Douglas P. Nanney is hereby reinstated to the practice of law in the State of
Tennessee subject to the following conditions:
a. Mr. Nanney shall enter into a Monitoring Agreement with the
Tennessee Lawyers Assistance Program (TLAP) for a period of at least one (1) year or
longer subject to the determination of TLAP.
b. TLAP shall have authority to structure the conditions of such
Monitoring Agreement as it deems appropriate.
0. Mr. Nanney shall be required to submit four (4) random drug screens
each year for a period of three (3) years.
d. The Board of Professional Responsibility shall be made a reporting
party to the TLAP Monitoring Agreement and random drug screens.
e. Should Mr. Nanneyâs TLAP Monitoring Agreement expire prior to
his obligation to submit random drug screens, Mr. Nanney shall be responsible for
engaging a Substitute agency for the submission and reporting of random drug screens.
2. Pursuant to Tenn. Sup. Ct. R. 9, § 24.3, Mr. Nanney shall pay to the Board
of Professional Responsibility the expenses and costs of this matter in the amount of
$1,975.20 and in additiOn, shall pay to the Clerk of this Court the costs incurred herein,
within ninety (90) days from the entry of this Order, for all of which execution may issue
if necessary. '
3. Mr. Nanney shall complete an additional 325 hours of
Ethics/Professionalism CLE for the 2012 compliance year and shall pay to the
Commission on Continuing Legal Education and Specialization $174.50 in course
reporting fees.
4. The Board of Professional Responsibility shall cause notice of this
reinstatement to be published as required by Tenn. Sup. Ct. R. 9, § 18.10.
