JACKSON ATTORNEY PUBLICLY CENSURED

Charles A. Spitzer, a Jackson, Tennessee attorney, has been publicly censured by
the Board of Professional Responsibility for representing a client in a divorce action and having
a sexual relationship with the client. Spitzer left his client files at his client’s house, thereby
breaching his client’s confidentiality. Respondent’s actions violate Rules 1.6; 1.7(b) and 8.4(a)
and (d) of the Tennessee Rules of Professional Conduct. The Board of Professional
Responsibility censured Spitzer for these violations upon the condition that Spitzer enter into a
monitoring agreement with Tennessee Lawyers’ Assistance Program (TLAP), and provide proof
of such agreement to Disciplinary Counsel. Any reported incidence of noncompliance shall
constitute grounds for immediate summary suspension of Spitzer’s license. Spitzer did enter the
monitoring agreement with Tennessee Lawyers’ Assistance Program.

The imposition of this censure declares Spitzer’s actions to be improper ethical
conduct, but does not limit his right to practice law.
