WILLIAMSON COUNTY LAWYER CENSURED

On January 12, 2011, Shawn Sirgo, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.

Shawn Sirgo was paid by a company to represent an employee in the defense of his criminal DUI
charge. Mr. Sirgo later participated in the termination of the employee from the company. Mr. Sirgo
disclosed the amount of fees charged in the employee’s case to the company and the company withheld
that amount from the employee’s last paycheck in violation of state law. Mr. Sirgo thereafter filed a
counter-suit in a civil action which named the company employee as a defendant in a matter substantially
related to the representation which caused the conflict of interest.

By the acts as stated above, Shawn Sirgo violated Rules of Professional Conduct 1.6
(confidentiality), 1.7 (conflict of interest), 1.8(f) (conflict of interest, prohibited transactions), and 1.9
(conflict of interest, former client) and is hereby Publicly Censured for these violations.
