LEXINGTON LAWYER TEMPORARILY SUSPENDED
On August 25, 2003, the Supreme Court of Tennessee issued an order summarily and
temporarily suspending Tom A. Nacaratoâs license to practice law, upon finding that Mr.
Nacarato had failed to answer a complaint of misconduct. Section 4.3 of Supreme Court
Rule 9 provides for the immediate summary suspension of a lawyerâs license to practice law
in cases of failing to respond to the Board of Professional Responsibility. Disciplinary
Counsel filed a petition with the Supreme Court alleging that Mr. Nacarato had failed to
respond to the Board regarding a complaint.
The August 25, 2003 order precludes Mr. Nacarato from accepting any new cases
effective August 25, 2003. Mr. Nacarato must cease representing existing clients effective
September 24, 2003. After September 24, 2003, Mr. Nacarato shall not use any indicia of
lawyer, legal assistant or law clerk nor maintain a presence where the practice of law is
conducted.
The order requires Mr. Nacarato to notify by registered or certified mail all clients
represented in pending matters, all co-counsel and opposing counsel of the Supreme Courtâs
order suspending his law license. Section 18 of Supreme Court Rule 9 requires Mr.
Nacarato to deliver to all clients any papers or property to which they are entitled.
This suspension remains in effect until dissolution or modification by the Supreme
Court. Mr. Nacarato may for good cause request dissolution or modification of this
suspension by petition to the Supreme Court.
