MEMPHIS LAWYER PUBLICLY CENSURED

On April 14, 2005, the Board of Professional Responsibility issued a public
censure to Arch B. Boyd, III. He did not request a hearing. Respondent neglected his legal
matter, failed to adequately communicate with his client and failed to refund any monies after
being terminated. The Board issued the public censure on the condition that Boyd submit the fee
matter to the Memphis Bar Association Fee Dispute Committee to determine whether a refund is
due and if so, in what amount. The Board determined that Boyd’s conduct was in violation of
DR 1-102(A)(1)(5)(6); DR 6-101(A)(3) and DR 7-101(A)(1)(2)(3)(4) of the Code of
Professional Responsibility. A public censure is a form of discipline that declares the conduct of
the lawyer improper but does not limit the lawyer’s right to practice law.
