KNOXVILLE LAWYER CENSURED
Aubrey L. Davis, of Knoxville, was publicly censured by the Board of Professional Responsibility on
April 22, 2008. The censure was issued by the Board pursuant to Rule 9, Section 8 of the Rules of the
Tennessee Supreme Court. Davis did not request a hearing on the matter.
In representing a criminal defendant on appeal, Davis failed to timely file the appellate brief, and failed
to file within an extension of time granted by the Court of Criminal Appeals. Ordered to show cause, Davis
assured the Court that he would file a brief within a second extended period, but failed to do so and failed to
communicate with the Court. The Court found Davis to have been âgrossly negligent in the performance of his
duties to his client and to this court,â and âin willful contempt of this court.â Davis was then relieved as
counsel and replaced by another lawyer. The Court then informed the Board of its action. Davis completely
failed to respond to the complaint or to communicate with Disciplinary Counsel until he was temporarily
suspended from the practice of law under Supreme Court Rule 9, Section 4.3.
Davisâ conduct violated Rules 1.3 (diligence on behalf of clients) and 8.4 (misconduct – conduct
prejudicial to the administration of justice) of the Tennessee Rules of Professional Conduct. This censure
declares Davisâ conduct to be improper, but does not limit his right to practice law.
