ORDER TRANSFERRING ATTORNEY TO
DISABILITY INACTIVE STATUS
This matter is before the Court upon a petition to transfer Carla L. Arevalo to
disability inactive status filed by the Tennessee Board of Professional Responsibility
pursuant to Tenn. Sup. Ct. R. 9, § 27.4.
Upon due consideration of email correspondence from Ms. Arevalo to the Board,
the Court concludes that Carla L. Arevalo is currently contending that she is suffering
from a disability by reason of mental or physical infirmity or illness, which disability
makes it impossible for her to respond to or defend against the Petition for Discipline in
Docket No. 2018-2848-5-WM.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT THAT:
1. The law license of Carla L. Arevalo shall be transferred to disability
inactive status for an indefinite period of time and until further orders of the Supreme
Court.
2. This matter is referred to a hearing panel for a formal hearing to determine
Ms. Arevaloâs capacity to continue to practice law and to respond to or defend against the
Petition for Discipline, pursuant to Tenn. Sup. Ct. R. 9, § 27.4(a). In such proceeding, the
burden of proof shall rest upon Ms. Arevalo and shall be by a preponderance of the
evidence.
3. The Board shall publish notice of this transfer pursuant to Tenn. Sup. Ct. R.
9, §§ 27.5 and 28.11.
4. Pursuant to Tenn. Sup. Ct. R. 9, § 32.4, documents other than this Order
relating to Ms. Arevaloâs disability proceeding shall not be public records and shall be
kept confidential.
5. The Court deems it proper and advisable to suspend disciplinary
proceedings again Ms. Arevalo until further Orders of this Court, pursuant to Tenn. Sup.
Ct. R. 9, § 27.4(b)
